1. Definitions

• BV IMM Brokers - the trading name of BV IMM BROKERS S.R.L., a legal entity headquartered in Brasov, Romania, registered at the Trade Registry under no. J8/942/2011, fiscal code 28561100, EUID ROONRC.J08/942/2011, enrolled in the Secondary Intermediaries Register of ASF under no. RAJ-503173, part of the Millenium Insurance Broker (MIB) Group.
• Seller - an employee of BV IMM Brokers or any partner with the right to distribute insurance products.
• Buyer - any natural or legal person that submits an Order via the Website or directly to the Seller.
• Website - the domain brasovbrokers.ro and/or its subdomains.
• Order - an electronic document or written/verbal request constituting a form of communication between the Seller and the Buyer, through which the Buyer expresses the intention to purchase insurance products.
• Product - any brokerage service or insurance policy provided to the Buyer pursuant to a concluded Contract.
• Contract - the agreement concluded between the Seller and the Buyer, including at a distance, without the simultaneous physical presence of both parties.

2. Acceptance of Terms and Conditions

• Use of the Website implies full and unconditional acceptance of these Terms and Conditions.
• Services provided through the Website are reserved exclusively for persons who have reached the age of 18.
• By submitting an Order, the Buyer agrees to the form of communication through which the Seller conducts its commercial operations.
• All content on the Website is protected by copyright law, with all rights belonging to BV IMM Brokers.
• Complaints may be submitted in writing to office@brasovbrokers.ro, including the Buyer full name, email, postal address and description of the issue.
• BV IMM Brokers shall not be liable for any direct or indirect damage caused in connection with the use of the Website, errors, omissions, malfunctions, delays, viruses, or similar factors.
• Information on the Website is for informational purposes and may be changed at any time without prior notice.

3. Rights and Obligations of the Seller

• BV IMM Brokers acts as a brokerage assistant of Millenium Insurance Broker and is not a direct provider of insurance products.
• The notification sent to the Buyer after submission of an Order is for informational purposes only and does not constitute acceptance of the Order.
• The Seller may assign and/or subcontract a third party for services related to fulfilling the Order, without requiring the Buyer consent.
• If a product cannot be provided, the Seller shall inform the Buyer and refund any amount paid within a maximum of 14 days.
• The Seller may cancel the Order with prior notice in the event of: non-acceptance by the issuing bank; invalidation by the payment processor; provision of incorrect or false data by the Buyer.

4. Rights and Obligations of the Buyer

• The Buyer undertakes to complete all forms with accurate and truthful data.
• By placing an Order, the Buyer confirms: consent to GDPR data processing; that all data provided is correct and accurate; that the Seller may contact the Buyer to validate information required for quoting or issuing a policy.
• The Buyer is obliged to update their data whenever circumstances require it.

5. Billing and Payment Policy

• In accordance with applicable legislation, no invoice is issued for insurance policies, as the policy itself constitutes the payment document.
• Products and Services will be provided to the Buyer only after payment has been made.
• The purchase price is that communicated in the transmitted offer and may vary depending on each insurer policy and the information declared by the client.

6. Cancellations and Modifications

• The consumer has the right to unilaterally terminate a distance contract within 14 calendar days, without penalty. For life insurance and individual pension contracts, the period is 30 calendar days.
• The right of unilateral termination does not apply to travel/baggage insurance or short-term policies of no more than one calendar month.
• Any errors recorded in the policy will be corrected through addenda issued by the insurance company.

7. Confidentiality

• Information provided by the Buyer will remain in the use of the Seller at least for the duration of the contractual relationship.
• No public statement or disclosure to third parties regarding the Order/Contract shall be made by the Buyer without prior written consent of the Seller.

8. Force Majeure

• Neither party shall be liable for failure to fulfil contractual obligations caused by a force majeure event.
• If within 15 days of the occurrence the event has not ceased, either party may notify the other of the termination of the Contract by operation of law, without damages.

9. Applicable Law

The applicable law is Romanian law. Any disputes shall be resolved amicably or, where not possible, by the competent Romanian courts.

10. Personal Data Processing (GDPR)

Purposes of processing: client identification; premium quotations; contract proposals; policy issuance or renewal; collections; marketing for insurance products; fulfilment of legal obligations.

Legal bases: consent for marketing; performance of the insurance contract; compliance with applicable legislation (insurance law, anti-money laundering legislation).

Categories of recipients: insurance/reinsurance companies, PAID, FGA, BAAR, state authorities, IT providers, banks, archiving providers, law firms, courier companies, other insurance intermediaries.

Duration: general insurance - 60 days from quotation date; life insurance - 180 days from quotation date. Data relating to issued contracts is stored per applicable legislation.
